Non paying committee member

Hi Nigel,
We have a committee member who was appointed unknown to me and has not paid any communal fees for 2 years.
Is this legal?
Can we vote against this appointment and remove them from the committee?
Any advice appreciated.

Hi akabennyg

If anyone fails to pay their communal fees - "the Management Committee may proceed with any act and expense which is reasonably necessary for this purpose and may recover by legal action the sum owed by the non-conforming owner in accordance with the provisions of this Law."

Unfortunately, you cannot remove them from the committee, but at the next general meeting, you can vote against their appointment.

(The law permits people who are not unit owners to be members of the committee.

I suggest the other members of the Management Committee speak with their lawyer and possibly take the debtor to court to recover th edebt.

In addition to what Nigel has written, the non-paying member will not have any voting rights at the AGM while communal fees are outstanding!
