Noise Law

Post by MariaS »

Hi Nigel,

The apartment owner, who ( your quote & still makes me laugh) speaks through an orifice normally reserved for another purpose, is continuing to cause problems. This time, however, it's to do with noise.

I've had some work done in my apartment. The work has been completed for now, but over the next few months I will be having more work done.

We've had a verbal policy in our small complex that if any work is being carried out in an apartment, out of respect, the apt owner would send an email out to the other owners informing them that there will be some noise coming from the apartment. Which is what I did. However, this wasn't good enough for her. Her husband works at night, comes home at 8am & sleeps. I'm supposed to let them know, the day before, if there is to be some loud noise the next day between the times of 8am - 3pm. If there is, then her husband can go to her mothers to sleep. She has said that the police informed her that there should not be any noise from 12.30pm & has basically sent me a written notice!!!!

I presumed she called Kiti Police Station as that's where we live. When I called them for clarification, they had no idea what the public quiet time was. Three days later, I'm still waiting for a call back. In the meantime after searching on Google I'm led to believe that it's from 3pm - 5.30pm in the summer, which I kept to, knowing it's siesta time.

I just want to also add that on one occasion after her endless emails, I did say that there would be noise the extra day, however, her husband still came home to sleep!!!

I can't see anything in the Immovable Property Law regarding the above apart from section 4 which states under Part IV, 7iii "No owner or occupier shall use any unit generally for any use which may create noise......."

What's laughable is that this owner and her husband, who is quite placid, bless him, have never informed us of any major works done in their apartment, have no problem using their drill anytime during the day or night, moving furniture around in the midnight hours etc. 😆

Thank you in advance.

Hi Maria

As far as I am aware, there are no laws governing the working hours of construction workers in Cyprus. They can start work when they like and finish where they like.

There is a traditional siesta time, which I think is between 13:00 and 16:00 or as you say 15:00 to 17:30 (I haven't been able to confirm), when you are supposed to stay quiet.

Building work usually starts around 07:30.

Maybe you could visit the Kiti Police Station and ask them directly.
