hi nigel
I wonder if you can help me. I am sure this as been queried before, but here go's I have a house on a complex consisting of 8 houses and 3 floors of apartments containing 20no of mix 2and 3 bedrooms, in addition there is a small swimming pool some gardens, and a gated entry road into the complex for communal parking and to parking for the houses. After 9 years we are still awaiting our title deeds. The developer as maintain the complex throughout this period charging an annual fee. He now wishes to stop the maintenance and for us tenants to form a committee and maintain it ourselves, my question is, is he legally obligated to carry out the maintenance as he officially owns the properties till title deeds are issued and is he obliged to on safety and disability grounds on any EU directives that may apply, there is a lift and disabled toilet within the apartments, sorry its long winded but any light you can shed on this would be appreciated

Hi castleton

The developer is under no obligation to carry out the maintenance and you should set up a Management Committee to look after things.

A guide on how to do this can be found in the official English translation of the jointly owned buildings law.

A couple of other useful items:

There are many people without deeds that have set up Management Committees - and I suggest that you each of the buyers on your development applies for their deeds.
