We have been in contact with our developers since oct 2913 our deeds are available we came out in April to buy the deeds and the developer has fobbed us off saying he can't get through to the bank of Cyprus to get deeds released. He has now had 6 months notice of our proposed visit in 2 weeks, he has said he is trying to get hold of the bank of Cyprus and is awaiting a response, am I being fobbed off again, or are they using my deeds to support loans they gave. How can I get my deeds

Hello Marynunn and welcome to the forum.
There is a delay in getting the deeds freed up for the transfer, but I cannot say what may be causing this. Surely your developer can pick up the phone and call the Bank of Cyprus to find out what's causing the problem?
As you will be coming to Cyprus in a couple of weeks, I suggest you do a bit of research yourself at the Land Registry by asking them for a Title Search. This will show all outstanding claims against the property that may be delaying the transfer. You'll find information on how to get a search at http://www.news.cyprus-property-buyers. ... /id=004888 together with the required forms. I believe the cost is about €20 and it will take the Land Registry a few days to produce the search certificate.
You may need someone to help translating the certificate (it's in Greek).
You will not be able to get the deeds to the property until any claims that pre-date your contract of sale have been removed - and the search certificate will list these (and others) when you meet your developer.

I don't see what the BoC have to do with this tbh, the deeds are either ready for transfer or not.

Unfortunately my husband is ill and we will no longer be able to come out to Cyprus on friday. we have emailed the developers over 10 times and they are not even replying to emails. We also have friends in Cyprus who have tried to contact the developer who is not being very helpful.
We were told our deeds were ready two years ago and have been trying to purchase them ever since.
I think that the developer must be using our deeds as collateral for a loan and thats why the Bank of Cyprus are involved.
We paid cash for our property so there is no mortgage on it, all management fees are upto date so there is no other reason for them not being able to complete this transaction.
Can anyone recommend a way ahead with trying to get our deeds, so if my husbands illness is confirmed as terminal that the deeds are in our joint names.

I'm sorry to hear that your husband is unwell - I hope he makes a speedy recovery. (I had a cancer scare a couple of years and I know how worrying this must be for you both).
If your friends are having no success in contacting your developer, perhaps your lawyer can be of service? And you can try to contact him by phone.
