What we can't understand is that the flat below us was sold in May 2012 therefore we did not envisage any problems in selling ours. What and could have things changed?

I suspect that the 'memo' was lodged at the Land Registry after the flat below you was sold in May 2012.

Once you get the N50 you'll need someone to look at it and explain it to you. Once you know what the problem is, you can set about addressing it.
