Sewage Treatment Plant

Hi
I am curious if any one can shed some light for me.
I am thinking of Selling. But My developer installed the other year a so called sewage treatment plant. of which (as expected) is very shoddy workmanship. my fellow neighbors and I put to the developer in writing some conditions of acceptance for us to take on this plant that NEVER did work correctly and leaked sewage every where.
The reply was for the developer to turn it off and lock the lids shut and not to come near it again(over a year ago now). this was only installed as a means for the developer to gain permission to put 3 Villas on our green area ! (transfer of covered land quota from some where else ?)

My point is if I try to sell the developer will probably try to recoup some money for this installation in the form of a transfer fee. as we now know they are against the law. So what do I do if the developer asks for money in the form of a transfer tax and on the face of it refuses to transfer my intend to purchase certificate to a potential buyer without money being involved ?

Hi Uboat and welcome to the forum.

I believe that if a development consists of more than 12 units, the developer is required to provide a sewage plant.

Regarding Transfer Fees, these are payable to the Land Registry - I think what you are referring to are contract cancellation fees? If so, it may be possible, under the provisions of the new Specific Performance Law introduced earlier this year, to assign your rights under the contract you have with the developer to a third party - and the developer will have no say in the matter. I suggest you discuss this with your lawyer as I am unsure of exactly how this assignment works.

Yes I was referring to the point you mentioned.
I will ask my Solicitor,
Re the sewage plant though, we never had one for about 7-8 years but we did have a Green area! then all of a sudden we had 3 Villas on the green area and a sewage plant? As I stated dose not function without leaking from Day 1. And is now isolated by the Developer himself.
He installed it in a very cheap and shoddy manor then switched it on without the manufacture commissioning it. during that short time of only may be 6 weeks all the pipes under the surface broke as the whole lot sank under the weight of sewage etc and the holding tanks leaked like sieves into the ground (contaminating it with raw sewage). one directly into the pump pit.
He then only wanted us, "the owners" to take over the running of the plant /Maintenance etc.(Obviously he was now thinking we can pay for the repairs) So we collectively agreed a set of terms under which we would consider this. put it to him. His reply, as I stated was to switch it off and lock all the lids shut. No discussion no contact. That is how it is today well over a year now. our site has 26 properties and we use one open bottomed ses pit and another crudely bored (by the developer) right next to the sewage plant(which has probably caused it more damage) our council (Sotira) do not seem to be able to do anything about it, neither do the Health people, we have had them all round. the original ses pit backs up and leaks fluid into the soil around. it is half in one of the new villas property. Yet still NON of the authorities are willing to Make the developer put it right.
It stinks of corruption.
So the wheel goes round and round.
There are only a very few of us on site now who take any interest in situation the others dont seem to want to know any more! and even we are fed up with it all now.
Is there a way forward ?
