Having taken advice I will not publish at the present time but hopefully this relatively quick turn around by the CBA and AG into actually holding disciplinary proceedings rather than just another hearing into my case in October might give others some hope. Maybe things are changing.
Not going to count any chickens but it is a big step forward particularly when The Stigette is involved.
Andy P keep us all posted how this all pans out, I think it has been commented on not only on this forum but others that many Cypriot Lawyers are in horror over the Cyprus Bar Association leadership and there ways dealing with the grievances from clients.
@ Andy P Would not hold your breath on the Disciplinary Board, Maybe with the CBA electing a new President next year the Board may decide to protect clients from rogue members off the CBA Union ?
There is a on going case just now where the Victim has been told by the CBA President he will not communicate with him he also refused to accept any evidence given to him even though the evidence was given by Cypriots.
Now Maybe the President of the Cyprus Bar Association feels that he is Protecting fellow Cypriots who voted for him. Against outsiders not born in Cyprus and does not want outsiders to laugh at the antics off his members who have engaged in legal applications breaking the CBA Code off Conduct, commiting perjury plus other criminal acts.
( I think Petros Clerides the Attorney General has also made another strange legal decision on Lawyers who commit perjury )
This case I beleave is the CBA President has been asked to commit himself in writing to provide a written defense off his members involved in the Complaint.
So far the CBA President has resisted what to many would be a simple task off ending the complaint by writing a simple defense / explanation to the Client/victim
Maybe the CBA President is stalling and waiting for the next President off the CBA to handle this very simple Task.
It would appear from today's Cyprus Mail that it is not just me who has been waiting for a decision from the CBA. Having said that I must have the record as I am over two years without a decision.
50 complaints per month according to The President of CBA. Surely this does not merit just an eyebrow being raised! There has to be something very,very wrong here.
A lady with 25 outstanding complaints and no record of a guilty verdict. Alarm bells again. Must be Melwills chum and mine!
Amazing the comments from the CBA President, especially in the light off his written statements to victims over the last few weeks where he complains one victim is the only one to complain and refuses to have any communication.
Another victim he writes he is not responsible (seems to be a popular phrase now in Cyprus when troubles loom.)
So in 2011 is the Disciplinary Board chaired by the AG protecting Clients & Public from rogue lawyers ?
Nigel. Further to your earlier suggestion re complaint to Ombudsman I received a reply from them today confirming that The Advocates Board falls outwith their remit. Surprise!
I am surprised that the Advocates Board falls outside the remit of the Ombudswoman. It is chaired by Petros Clerides who is a government appointed official - so it is part of government.
With 25 complaints and rising I cannot see how the Stigette will not eventually be barred from practising. Her complete disregard for the law over a number of years will catch up with her eventually. i am a great believer in what goes around comes around. I would imagine the rest of the profession want her barred before she does any more damage to the reputations on Cyprus lawyers ie those that do genuinely protect their foreign clients interests.
Yes you are correct the Ombudswoman has no remit BUT EVEN worse the President of the CBA Doros Ioannides refuses to accept there letters as evidence to be examined by the Disciplinary Board as you know Doros is Vice President off the Board.
Then if you consider the President off the Board is Petros Clerides the Attorney General on his latest ruling concerning a certain lawyer commiting Perjury in a court case involving Conor O Dwyer That it was not Perjury even though the Chief of police (and maybe the rest off the world regard it as perjury)
Does not look good for Justice to prevail when the President & Vice President off the Disciplinary Board find it hard to accept evidence from Non CBA members ?
As Gavin Jones excellant letter in the Cyprus Mail on his own case where a Paphos Lawyer Gave Avadavits to Cyprus Courts asking for the Lawyer to be the sole executor off Gavins Mother estate
The Board called it Clerical errors !!!!!
It appears the Cyprus Bar Association Disciplinary Board PROTECTS its members through thick and thin against the Victims off there rogue members
Scots Lad. Obviously your earlier posts were correct. the ombudsman has been taken out of the equation as far as The Bar are concerned. I have however questioned this as we are charged a fee for a service. The Ombudsman says they do not provide a service.
Melwil my aim in life is to take The Stigette down. She is a poor excuse for a human being. Yet she is allowed to continue and trade and the law protects her from me saying E L allegedly did whatever.
I think many members of the Cyprus Bar Association could stay in the BAR L in Scotland !! There form I think would make it almost a certainity if they practised as they do in Cyprus.
Hi Nigel. Having waited about 3 months for a response from the Ombudsman I wrote back to them immediately questioning why they could not help. Today I received a very prompt reply just confirming they could not. They did however suggest that I complain to The Attorney General. Are they serious or just having a laugh?
Anyway I have decided to give up on that avenue as luckily I still have a hearing in October to attend.
