Contract of Sale/ Land Registry

Post by Elena »

My lawyer who had power of attorney for me signed a sale contract with the purchaser for my house and deposited it with the land registry office
The purchaser will not hand over the money because there are no title deeds and mortgages on the some of the complex properties but not mine
5 years ago when i bought new the developer said they would do everything for me but DID NOT deposit the contract of sale at the time
So someone has my house as sold and registered with the land registry as theirs but no money has been handed over
I feel my lawyer has been tricked and find myself in this position
What do i do as my lawyer has been exposed as i have

Dear Elena,

Welcome to the forum.

If someone has purchased your house they are obliged to fulfil their obligations as stated in the sale contract.

They cannot decide not to pay you because the house has no Title Deed. And your original contract with the developer is still valid even though it was not deposited at the Land Registry.

I feel the only solution is to sue the person who bought your house - and your lawyer should be able to help you with this.
