Unit ownership with land on complexes.

Hi All,

I am looking for some clarification with regards to Cyprus law and property land ownership on communal complexes.
Specifically those untis with individual land assigned, houses or townhouses sharing a common pool area.
The communal area is defined (to my understanding)as the pool area, but I been informed that the land surrounding the individual plots are communal land too, but the owner of that unit has exclusive rights to it. Is that correct?
Furthermore, any erections on that exclusive land would need the Committee's / other owner's permission to build a permanent structure on it, like a pagoda, as it's officially defined as communal?

Hi Darren

If you have the Title Deed for your unit, you will see whether the land surrounding your unit is communal land. (But I suspect it isn't communal land.)

But regardless if whether it is your land you cannot erect a permanent structure on it without planning permission.
