Obtaining Title Deeds - ( No contract of sale in Land Reg'y

Hi Guys,
Quick question - Our Title deeds are highly likely soon to be available - just one glitch - our Contract of sale had been removed & not put back in the Land Registry.
Would this prevent us buying/obtaining our Title deeds?

Most certainly, as you are not the registered owners. I hate to say this but if you have no contract at the land registry the house belongs (in law) to the original owner be it developer or otherwise.
The title deed will come out in the name held at the land registry (and it won't be yours). Why was your contract removed??
You should be taking some urgent serious legal advice, you may end up with no property!

I concur with Pantheman. This is very serious and you need to take legal advice.
Apart from yourself, the only person who should have been permitted to remove your contract from the Land Registry would have been your lawyer acting under a Power of Attorney (or perhaps someone else you'd appointed as your Power of Attorney).
So DO NOT USE your current lawyer - get another one to look into this for you. (You may be able to find out who removed it by visiting the Land REgistry taking your passport and contract with you.)

Hi Pantherman/Nigel,
We do not exactly know why our contract of sale was removed - but we do know it was our Lawyer who had POA at the time who removed it without our knowledge & never put it back into LR, this happened back in 2004
We have only within last 6 months found out that CoS was removed & by whom.
Currently we can only speculate on the reasons why he removed CoS - may be for further borrowing!
To make matters worse - Alpha Bank will not progress our Swiss Franc compo package because no CoS is held in LR.
Yet they insist we continue paying an Housing loan for a property that we may not even own.
Life's a Bitch sometimes !
Really appreciate your advice guys
We are using top Lawyer to try & sort this mess out
