Alpha Bank -Double Standards

Post by Brookster »

Hi Guys,
We took out a Housing loan with Alpha 2004 - STD CYP pound Housing loan/mortgage.
9 months down the line we were encouraged to switch to Swiss Franc Housing Loan/mortgage!
Summer 2014 we contact Alpha about being miss sold Swiss Franc product.

We were offered compensation - seemed a fair offer.

It was all progressing well. UNTIL we then we received an email from Alpha saying they couldn't complete the new housing Loan because the Contract of Sale (COS) had been removed from Land Registry.

We have recently found out that our COS was removed 1 week before we started our CYP pounds housing loan back in 2004. Our Lawyer had secretly removed COS in order to allow borrowing on our place - to-date we aren't sure if it was for the developer or Land owners benefit.

To make matters worse - we weren't aware at the outset, our Lawyer was also representing the Developer.
Estate agent recommended this Lawyer as well - So he must be culpable of some wrong doing here because he would have known Lawyer was also representing Developer.

The question I would like to ask - What are the chances of nullifying our Housing loan or Swiss Franc conversion with Alpha Bank - due to them having double standards?

Any feedback appreciated.

Dear Brookster

You will need another lawyer to look into this, find out what happened and take appropriate action.

There has been a similar case involving Scottish expats Andrew and Patricia McClay, you can read the outcome at Bar Association fines lawyer for misconduct.

The British High Commission publishes a list of English-speaking lawyers who may be able to help.

(The only people who could have removed your contract of sale from the Land Registry would have been yourself or your lawyer acting under a Power of Attorney.)
