I wonder if you could let me know who should pursue non payers on a complex if the Committee is unable to be registered at the Land Registry due to the Developer not submitting the paperwork required. We have been told by our Deverloper it will be mid 2009. The Land Registry refuse to let us register our Committee as we have no AX number to assign as no case is filed by the Developer.
The Committee are being asked by our management company to pursue the non payers by taking legal action, but after consulting a lawyer, he said he could not proceed as we were not registered.
Is it now the Developer's responsibility to chase the non payers. The management company is owned by the Developer by the way!
