Apologies for posting on this forum, but I hope some knowledgeable individuals among you may be able to assist with our situation.

My husband and I initially rented a property on a development in Cyprus a little over 2 years ago, with a view to eventually buying a property in Cyprus. Due to Brexit we decided to postpone any idea of purchasing until the long term impact was clearer. We have recently renewed the tenancy for a third year. On returning to the apartment last month were greeted by a letter from the Developer's credit control officer indicating that they were aware we were renting the property from an owner who is failing to fulfil their obligation to pay communal charges for the complex. They asked us to contact them ourselves or to pass the letter to the rental agency; we elected to do the latter. The agent forwarded the letter to the owner and we were subsequently informed by the agent that the owner is in dispute with the developer and wishes the situation to continue as is and that we could not be thrown out as he owns the property.

We have now been approached by the owner of another apartment who advised that there are several non-paying owners on the development and that we are in a precarious position, indicating that bailiffs could enter our apartment at any time without notice to repossess/remove any goods. Our rental agent indicated that they have not heard of such a situation occurring. The apartment is furnished, but a significant number of possessions - electrical and otherwise, are our own, all of which are covered by our own contents insurance. We do not know if the owner has a mortgage on the property or not, and all utilities are in our names.

Please can anyone advise the legal position with regards to tenants where an owner is not paying communal charges? Understandably, we are concerned by this situation, especially since we do not live permanently in Cyprus and are worried that we could return on a subsequent visit to find all our possessions have disappeared.

Dear Serephina,

There is no such thing, no bailiff can come enter or otherwise. If anyone does call the police on 112, and report a robbery!

The owners legal matters are not your concern, things like this need to go to court to get a court order and that could take considerable time.

The info given by the other owner was scare tactics to get the non payer to pay. The do have the right to block you from any facilities the complex may have such as swimming pools etc.

You have nothing to fear over this.

Dear Pantheman,

Thank you for confirming that this problem isn't our concern.

I suspect that you're right and this was just scare tactics. While I can obviously sympathise that it must be frustrating for paying owners that non payers do not meet their obligations, I suspect there was a hope that we'd consider terminating our lease to hit the apartment owner in the pocket so to pressurise the owner into paying. We have insurance and the means to monitor the property remotely so won't lose any more sleep over the issue.

As for the complex facilities, we'll face that hurdle if it comes to it.

Unfortunately those who pay need to make up the shortfall caused by those who refuse to pay.

There are a number of problems with the relevant law - hopefully the government will sort it out one day.
