Title Deeds for turkish owned land in the South

Hi Nigel
I am a UK citizen (living in UK since 1968) of Turkish Cypriot origin, both parents Turkish Cypriot.

My father who had various plots of land in the south (government controlled part of Cyprus) was born and lived in Cyprus and sadly died in North Cyprus in 2001. He had however distributed his land to myself and my siblings while he was alive according the land registry rules applicable in the north Cyprus and each of us have the title deeds as issued by the North Cyprus authorities. This was carried out before the TRNC was declared.

My question is as follows:
Are the Title deeds (issued to me in Turkish in north Cyprus) for the land I have inherited in the government control area in the south valid in the government control part of Cyprus?
or
Do we now have to do a probate in the South and in order to re-distribute my father's land?
Any advice and information will be most appreciated.

Hi Kemal and welcome to the forum,

I'm afraid that the Title Deeds issued to you in northern Cyprus are only recognised by Turkey and the authorities in the north.

As you may imagine, there are many thousands of displaced Greek & Turkish Cypriots who have problems with their land due to the current political situation.

What I suggest you do is contact the High Commission of the Republic of Cyprus in London who should be able to advise you on how best to proceed and get your late father's land registered in your name. The contact details are:

I suspect that your late father's Will will have to go through probate in the South for your claim to be legitimised. The British High Commission publishes a list of English Speaking lawyers who may be able to assist. You can get a copy of that list from the British High Commission's website at http://ukincyprus.fco.gov.uk/en/help-fo ... al-lawyers . But I suggest that you speak with the Cypriot High Commission first to find out what is needed.

Probate is not the only obstacle you are going to face.

To do anything with it, you have to get it out of the guardianship of the RoC. This can take a long period of time and there will be many hoops the jump through.

Under normal (for want of another word) circumstances, the owner would have had to take up residence in the RoC for at least 6 months before he could even apply for it back, but given your father has passed then the rules may be a little different.

If you don't mind me asking how large is the land and where is it located??

My late father's land is numerous plots amounting to about 200 acres (scalas). Does the amount of land has any bearing on the proceedings?

P.S. a scala and an acre are not the same. We talk about scales or donums in Cyprus. 1 acre=3.1 scales approx.

About the land.

About the title deeds i think is good idea to ask in the ''Department of Land and Survey'' in the town you are interesting. This is one department of Ministry of interiors.

In order to sale this land you have to be according to certain criteria.
You have to ask to the ''Urban Planning and Habitation Department''(is another department of ministry of interiors) in order to know if you can sell your land.

my t/c father left cyprus in 1957 . lived in uk since . he died 6 years ago and i have deeds to his and my nans and grandads land ... all now passed away .
im a uk and eu citizen ,born n raised here. i (6 years ago ) started court proceedings to claim my fathers land for myself and siblings on south side . to date ive only got as far as getting new deeds in my fathers name / his land . and valuations .
im getting really disheartened now ,as 6 years on and no end in sight !!!!!!!!
is this the norm ?????/
anyone else out there suffering the same fate or any help /suggestions ???

I'm not sure how you can move things forward - a could of other people have posted suggestion on who to contact.

Incidentally, I know people who have been waiting for the deeds for more than 20 years.

called cyprus to day for update with solicitor from limassol
i have updated title deeds now ,and valuations done .
been to court and been granted right to sell by judge now .
so hopefully reaching final stages ?
keep our fingers crossed that a buyer is found and sales go through smoothly !

Shame the 200,000 GC refugees don't have the luxury of getting their lands back huh?
