Title deed for an apartment

Our apartment has the final inspection certificate etc, but the developer has a mortgage on the complex.
We bought our apartment BEFORE this mortgage was taken out.
Should we be able to apply for our title deed separately or does the whole complex have to be cleared first?

Hi cyprusforme

As your contract of sale was deposited at the Land Registry before the developer took out a mortgage, that mortgage will not affect you.

All the Title Deeds for the apartments will probably be issued at the same time and, assuming the developer clears any tax liabilities he may have, getting the deeds will not be a problem.

Thank you for the reply, however my main question was:
Could we obtain our title deeds as there are no encumbrances on our property or do we have to wait for the whole complex deeds to be issued? Thank you.

Hi cyprusforme,

Yes - If you have the Certificate of Final Completion you can approach the Land Registry and ask them to issue the deeds. The Certificate of Final Completion will include all the other properties included in the building permit.
