Does anyone have any experience when a you own a property but it is only in one name and that partner dies, and you need to sort out probate, in Cyprus?
Has anyone any idea what solicitors fees should be in these circumstances are we talking €1000/€5000,€5000/€10000 or higher?
I am fully aware every case is different but would appreciate an indication of costs?

Re: Probate
Hello Max56
Did the deceased make a Will covering their estate in Cyprus? And if so did they appoint an executor? And is their executor a lawyer? And if it was a lawyer, were their fees written into the Will?
If the answers are yes, yes, yes, yes - you have your answer (they're written in the Will).
If the answers are yes, yes, yes, no - the fees are likely to be high - possibly 8% of the value of the estate - as the lawyer will use the minimum fees as laid down by the Cyprus Bar Association (assuming the lawyer was registered with the Bar). I will email you the formula.
If the answers are yes, yes, no... - it's up to whoever they appointed as executors to shop around and get competitive quotes for handing the probate.
If the deceased died intestate, then their estate in Cyprus will be disposed of in accordance with the Cypriot laws of inheritance. Their next of kin should shop around and get competitive quotes for handing the probate.
(Typically probate takes a year in Cyprus - possibly longer if the deceased dies intestate and family members have to be located).
Regards,

Thank you do not know any answers to your questions. We have are aware of a property owner who is in this situation who has been quoted in the region of €30,000.00 to obtain probate. When you say about 8% value of estate as the estate is only a small flat, is the value based on present days values or 1980 Title Deeds value?
So the best option is to obtain several quotes.

Re: Probate
It's based on the present day value of the estate.
I suggest the person you know gets some other quotations - see the list of lawyers provided by the British High Commission in Nicosia at https://www.gov.uk/government/uploads/s ... mplate.pdf
