Title Deeds

Dear Nigel

We have a apartment in a complex that we purchased off plan in 2006, which we still have not got our Deeds, its a complex which has three apartment blocks and fourteen houses.

The apartment we own have the lift installed but the other two apartment blocks have not had theirs installed, and doubt if they will ever will be.
Will we be able to get our Deeds?

Hi Cliimon and welcome to the forum.

You should be able to get the deed for the apartment you purchased. Changes to the law introduced in 2011 enable deeds to be issued for incomplete projects.

Really? There must be many conditions for this otherwise no one will finish their projects. One of the main reasons that many have no deeds is due to incomplete works, hence no FC.

I would certainly like to see this law if you could point me in the right direction!!

One of the provisions of the law (I don't know which one) was to enable a Certificate of Approval for part of a project and eventually Title Deeds to be issued.

Hi Pan,

I believe there are some issues with the interpretation of the law. At the eastern end of the island (on a completed development) people are being told that the Land Registry can only go as far as dividing the land into plots because one of the buyers has built a couple of illegal store rooms.

Thank you Nigel for your prompt reply.

The builder and estate agent are working together and advising owners on our complex to purchase the land to protect us, in case the builder went bankrupt, what would you advise?

You've already paid for the land when you bought the property - there's no need to pay again.

What you could do is have your names put on the deed showing that you own a share of the overall development. This will mean you paying the Property Transfer Fees. I think it best if you speak to your lawyer as I'm not sure of the implications if the developer has debts that have been registered against the land.

Dear Nigel

Two years ago l asked you if it was possible to get my Title deeds.
The problem l have is that there are three apartment blocks in which the builder has only installed one lift which is in the apartment block that l own , the complex was built in 2006, the question l asked you was would l be able to get my deeds if l applied for them which you said that it should be possible,so two years ago l applied for the Title deeds.

Now two years on after l first applied l decided to find out what stage they were at and was told there was a problem as there were no lifts installed in the apartment blocks although my apartment block has a lift.

Please can you advise.

I don't know why the fact that the other 2 apartment blocks do not have lifts is affecting you. As I said earlier the laws changed in 2011:

I attended a presentation on these laws in 2011 that you can read at http://www.news.cyprus-property-buyers. ... mnesty.pdf . It says on page 13:

"Your developer has not completed the project or has irregularities but your flat / maisonette is habitable, built according to the permits and has decent access (not necessarily public).

You can apply for a CoC and then for the corresponding title deeds. These will be issued in the name of the developer but the court can force him to transfer the property to you (The Department of Lands and Surveys has no such authority). The thorny issue is usually mortgages, unpaid fees and other financial obligations that must be met. No Amnesty provision will be used by yourself but will be most probably necessary for the developer."


Who advised you that you couldn't get your deeds because the other apartment blocks don't have lifts?

Thanks for your reply.
It was my solicitor that l had used to apply for my Title deeds that l had asked to find out at what stage my application was at .

I believed that the completion certificate had been issued although l have no proof of it as l have not seen any paper work.
The apartment block that my apartment in has easy access and is livable, no extra building has been added and has a proper road to the block, and has parking for cars, plus disabled parking .

What difference does it have if the developer has gone bankrupt as my new neighbor informed me that he has although again l have no proof.
