Green Area

Hi Nigel
On our complex, we all have our title deeds. We do maintain the green area (part of res assoc fees) but wondered who now owns this area? Who can expect to have access to this area i.e can anyone go for a walk through this area?

Hi pissouriabc and welcome to the forum.

As it's part of communal building, each of the property's owners own a share of the the green area. It may be used by the owners themselves, their guests and their tenants, like other communal facilities such as swimming pools.

Access to the green area could be restricted by fencing, signage or other means to prevent/dissuade the general public using it.

Hi Nigel,
Are you sure that what is designated as a "Green Area", adjacent to a communally owned development, is actually owned by the owners of that development?. My understanding is that these "Green Areas" which are provided as a condition to building approval by the developer, are actually owned by the local authority and as such should be maintained by the local authority. One reason for this thinking is that a few years ago these areas were irrigated from council owned water meters which were disconnected due to abuse by residents of the adjacent developments.

From what pissouriabc said, it's part of their commonly owned development - not an adjacent bit of land. (They'd be foolish to maintain it if it wasn't theirs.)
