Complex Pool

hi
We have a complex of 11 townhouses, there is no management committee and no one is running the pool " the pool is empty but needs a cover to make it safe, I have e mailed the owners but only 4 out of the 11 replied. Who would be responsible for organising a committee and how can you get the owners to be responsible for there houses and pay there share of any costs involved ( most are let out) ?

Hi Steve

I suggest you and the other permanent residents set up a Management Committee (as required by law). You can read more about this in the Jointly-owed property law.

Once established you can sue the non-payers.

People need to realise that failing to maintain and insure the 'common parts' of the development is a false economy; the value of their investment will deteriorate unless the common parts are properly maintained.

But the current law relies on the goodwill of people to pay. Although the Management Committee can sue them for non-payment, most probably all the court will award is an order enabling the Committee to lodge a debt (memo) against the Title of the property. This debt will only be recovered when the property is sold. Furthermore those who are prepared to pay will have to make up the shortfall.

The minimum number for a Management Committee is one, but try and get someone else.

As the complex is townhouses, do you have any other common parts such as gardens, paths, etc. that are shared by everyone?

We have no gardens , just a pool in the middle of the complex with tiled area surrounding it.
We also have an access road for vehicles to get to the rear of the houses with lighting and parking bays which are communal !

Hi Steve

You need a Management Committee. The pool, parking bays, access road are communal facilities - all will need insurance maintenance/repair. Communal lighting will need to be paid for out of communal funds.
