Re: Transfer tax if no title deeds

You don't have to use the assignment method, this if for avoiding Cancellation charges not Transfer Fees.

You could just have your contact cancelled during a sale with no TFs to pay.

TFs only become payable WHEN you are transferring a name on a title deed.

Re: Building Nuisance

Hello itchyfeet, I am not 100% on the times, but I would venture a visit to the town hall or district authority and speak to someone in planning. There are bound to be restrictions including weekend working. I will ask some questions and get back if I can get a definitive answer. Sorry can't help mo...

Re: Selling property advice please

Hi Nigel, I am entering into a sale contract for a property (have title deeds & no mortgage) with a UK cash buyer. I can be in Cyprus during the process and want to consider performing the transaction without unnecessary lawyer fees. I currently understand that I need to appoint a legal rep for tax...

Re: How to fund a refurb

Hello Flossy, unfortunately, you will not be able to get any loans/mortgage at the moment and the banks are being resolved and there are capital controls in place. When they do start to lend again, you will need a convincing argument to get a loan essentially be able to should income can support thi...

Re: Management committee Secretary

If there were other names for the position of secretary at the original voting that didn't get through, you could ask them. Alternatively, if there was no interest then no one can really complain and anyone can step in temporarily until the next meet. And come on, lets be honest, who's going to comp...

Re: Other owner's default payments

Hello Pan Thank you. Can we do the N50 search in England. How can Laiki Bank give us a loan 6 years ago to buy the apartment when there is already a loan out on the property? The agent took us to the land registry I presume this was to change the names over. What would happen if we stop paying our ...

Re: Other owner's default payments

Should my solicitor be able to advice me what to do because it seems at the moment we are stuck with the sale and we are frighten that the potential buyer will pull out. Yes - he should be able to advise you - that's what you're paying him for. As Pan has said, you need to do an N.50 search at the ...

Re: Property with ex husband - title deeds

Thanks Nigel. We divorced 5 years ago and I tried that back then but he wouldnt so the property was dealt with in the consent order at a time when there was equity. We both have to pay half costs until sold which is looking extremely unlikely. I have offered the property to my ex for nothing on sev...

Re: Other owner's default payments

Assignment contracts should only be used, IMHO, when all the checks have been made and there are not present encumbrances or problems on/with the property. I agree Pan - as well as avoiding property transfer fees one of the benefits of assignment/vesting contracts is that the new buyer will be unaf...

Re: Other owner's default payments

Hi lilykmac I expect the Laiki bank is dealing with other matters at the moment. As Pan has said, the memo on the land will not affect you - and the search he suggests will highlight all memos and any other charges there may be. I wrote an article about three years ago on how to get a Title search ...

Re: Other owner's default payments

Hello We have a buyer for our apartment but the only problem we are having is with Laiki bank. Apparently on our block one of the owner has defaulted on their payments and a memo has been sent to them but we have not received anything. For some reasons because of this we have to wait to hear from L...

Re: Is now a good time to buy?

I have been watching the property market for the past 18 months and now feel my time is right to purchase. The intention is to use it as a holiday home for friends and family, but also for holiday rental during high season in order to cover annual running costs. You haven't got a snowball's chance ...

Re: Title Deeds

Hi Angela, Your details are very limited to be able to give a more exacting reply, but i wonder. You say you have a copy? Is your name on it? Why not the original? Are you certain it is of your plot/property? Did you buy the house and received this deed? It woukd seem you have the title for the land...
