Re: Insurance Liability
Hi Rollwithit - thanks, I had a nice break in Lebanon - it's well worth a visit if you ever get the chance. Unfortunately, non-payment of communal charges is a very common problem - particularly when many of the residents are absent. As for insurance, you need to look at your contract of sale - this...

Re: Discovery of Ownership of Land
You're welcome fortyacres - and thank you for your comments. In answer to your question, there is an excellent chance that the undeveloped land will be registered at the Land Registry. And it may be possible to find out who owns it from the local Community Office - some of these maintain local recor...

Re: Discovery of Ownership of Land
Hello fortyacres and welcome to the forum, Unfortunately, it is not possible to search the Land Registry here in Cyprus as it is in the UK. In England and Wales The Land Registry operates an open register which means that copies of all documents referred to on the registered title can be obtained by...

Hi crystal,
Sorry for the delay in getting back to you. I would say that the developer is in breach of contract if he sold you a property that was mortgaged.
Did your lawyer advise you about this?

Re: Adjoining Plot
Hi Louise, Yes - this is becoming more of a problem because the Government is looking for more revenue during this recession. You can read more about this at http://www.news.cyprus-property-buyers.com/2010/04/25/is-a-property-only-worth-what-someone-will-pay-for-it/id=004712 I suggest that you speak...

Re: Ridiculous in Modern Europe
Hello Vah,
As you have found out, many property developers and agents will tell you what you want to hear rather than the truth.
I'm pleased to hear that you managed to find a decent lawyer - was it one from the British High Commission's list?

Ian, my apologies for the delay in replying - I have only just spotted your question. I have spoken recently with Louise on this subject. It possible for 'owners in waiting' to register. The owner is defined by the law as the person entitled to be registered as the owner or the actual person registe...

Re: Land Registry N50 info
What about the clause he signed in the contract, to deliver the said property free of any encumbrances? Where would that stand in a court? In my opinion the developer is in breach of contract - but you will need to have this confirmed by a lawyer. Can you type in the precise wording of the clause i...

Re: Land Registry N50 info
Hi crystal,
I don't know what I was thinking.
All the mortgages shown on the N.50 will be the developers. Buyers mortgages are guaranteed by the developer and so will not be shown by a title search.
