Sorry for the delay in getting back to you. I would say that the developer is in breach of contract if he sold you a property that was mortgaged.

Did your lawyer advise you about this?

Hi crystal,

I don't know what I was thinking.

All the mortgages shown on the N.50 will be the developers. Buyers mortgages are guaranteed by the developer and so will not be shown by a title search.
