Re: the last sentence, have sorted it now - I hadn’t checked the ‘remember me’ button! I received your reply ‘pm received’ but only in my email inbox- I wonder why it’s not come through on the forum as a pm in the usual way?

Re: Defaulting on a loan
Hi Nigel, I sent you a pm yesterday- you said that I had paused it (if so not intentionally). Did it come through eventually? Could you let me know how I actually sent a pm - I must be doing something wrong? I sent a few some years ago, perhaps I’ve just forgotten. Also, I keep being logged out & ha...

Re: Statute of Limitation on loan default
Sunlover1972, I would be cautious in assuming 6 years is the limitation period when it comes to property loans/mortgages. 6 years seems to apply to cases involving credit card debt, negligence/personal injury cases etc, but as far as i can see, it’s 12 years for housing loans. Google ‘statute of lim...

Re: Defaulting on a loan
Hi, this is primarily for Pantheman. Just reviewed my whole thread and would be grateful if you could clarify this. Pan, on 16 Oct 2017, you stated that I had a 'chance to cut lose' due to my circs & you were wondering why I was concerned about the writ having (possibly ) been sent to my previous ad...

Re: Defaulting on a loan
Hi Nigel, I very much hope that things are well with you these days. As per my last posts the Bank obtained a judgement against me in 2015 - nothing further has happened in the interim. Having reviewed all my papers recently, a few thoughts: ( 1 ) Guarantor - Apologies for raising this old chestnut ...

Re: Defaulting on a loan
Hi Sam, presumably, you've read my thread in full. Since the judgement was obtained by the bank, I've had no communication from 'anyone'. That's all I can tell you right now.
Good luck,
TD

Re: Defaulting on a loan
Good afternoon Nigel, Reference the judgment that has been obtained against me, I note on the Court paperwork that I am named as Defendant (1) and the Developer as Defendant (2). Would this appear to suggest that the Developer is being pursued by the Bank jointly with myself (ie.due to them acting a...

Re: Defaulting on a loan
Hi Nigel, I've now had a response from the Bank's lawyers after I had challenged them over the fact that the Court summons was sent to my previous address, thereby, denying me the opportunity to attend the hearing (I had informed the Bank of my change of address). I had suggested to the lawyers that...

Re: Defaulting on a loan
Thank you for your comments Pan - I do appreciate your input. As regards the developer not being able to find a buyer, I suspect what you said is probably correct. I had the property on with them for approx. 9 years, but hey, I guess they would always push their own properties first.
regards,
TD

Re: Defaulting on a loan
Thank you for your prompt reply Nigel. I don't have a lawyer acting for me, so, that narrows it down to 2 possibilities. If I was a betting man my money would be on 'they've sent it to the wrong address', because the address I lived at when I took out the Loan in 2004, is what's stated on the Court ...

Re: Defaulting on a loan
Hello Nigel, I hope you're keeping well these days. There has been a development in my case since we last spoke. Yesterday, I received a letter from a firm of Solicitors in Cyprus, who are acting for the Bank. Here are some of the key extracts: "As you are aware, the Bank commenced legal proceedings...

Odd Loan set-up
Hello Nigel, it's been a while since I've posted - I hope all's well with you. Here's another one for you. I took out a loan for CHF 120,000, in 2006, in order to purchase my apartment, to be repaid over 15 years (180 months). When I reviewed the paperwork many years ago, having become unable to mai...

Re: Defaulting on a loan
Happy New Year Nigel. I would like your opinion on this please. You may recall my case/situation from previous posts. I took the decision to incur no further expense with regard to this disastrous investment; ie £50000 lost is hard to swallow, and any more expenditure is only going to increase that ...

Re: Defaulting on a loan
Hi Nigel, I have just contacted the Developer from whom I purchased my apartment in order to find out what the current state of play is with it, as I haven't heard from them for a very long time. The property has been on the market through them (only) since around 2007 - I find it astonishing that t...

Re: Defaulting on a loan
Thank you. Not wishing to submit a lengthy post previously, I didn't go into all the details. I haven't engaged any lawyer to deal with this (more expense which I can't afford), because I don't have any assets here in the UK, or anywhere else for that matter! Seems a strange thing to say, but, with ...
