Re: Fees

I believe that the higher cost for higher priced properties is risk based to the law firm. Well yes, I'd expect lawyers to claim that and I fully accept that you believe it - but I don't. I had risk in mind when I made mention of insurance and attributing recovery of the premium to fees ledger acco...

Re: Fees

The price would very much depend on the selling price, I mean if you were to sell at 500,000 you would not expect to pay the same if you were selling for 100,000. Actually, I would expect to pay very similar fees - though I haven't yet tried to sell in Cyprus so haven't immersed myself in the detai...

Re: MEU1 Rental Agreement

Th S1 form enables HM Customs & Excise to stop deducting UK tax on your pensions, etc - as tax on your income will be paid to the Cypriot authorities. The S1 is issued by DWP in the UK and is a registration for health care cover. The Cyprus Ministry of Health will issue confirmation that you've sub...

Re: CGT

The latest situation regarding Capital Gains Tax is explained in ... Yes, of course I'm aware of that document and have checked against it and related documents when specific detail of wording in that DTA has been required. Article 13.1 confirms Cyprus also has taxing power over capital gain arisin...

Re: CGT

... what is the purpose of the DTT if what you say is correct? Apologies again for being a bit late but Nigel has it right in his latest comment. As I wrote, the idea of the DTA is that one doesn't pay the full tax on a transaction to both taxing countries: it gives relief from double taxation on t...

Re: CGT

CGT is paid in the country where the capital gain arises But not necessarily only in that country. Apologies for being so late with a comment but I imagine that things haven't moved very fast. OP is tax resident in UK so is subject to UK CGT on gains arising from disposals of overseas property - as...

Re: Applying for 'Final Completion Certificate'

Well, two years have passed and I'm resurrecting this old thread to provide a wrap for anyone facing the same situation. Application for final certificate duly completed at the district office (thanks for directions - exactly as you said, Nigel) but it seems to have then been filed and forgotten. At...

Re: Transferring funds to the uk

I've been doing this job for so long I can remember how to find all sorts of information :-) Unfortunately, links can suffer from 'digital rot' over time. This seems to be the webpage from which the current equivalent document (for 'physical persons' and wef 01/06/19) may be downloaded: https://www...

Re: Revision of 2013 Valuation

As Pan has said, the valuation is not the market value - it's the taxable value which is used to calculate property-related taxes. I seem to have been slightly misunderstood. As implied in my final paragraph, I know full well that it is not some statement of market value but a separate, notional va...

Revision of 2013 Valuation

I have today received a 'recorded delivery' letter from Dept. Land & Surveys dated 13 Feb. (post in this village is all too often like that). It refers to the date of purchase of my (resale & non-estate) house over 4 years ago and proposes a revised valuation as at 01/01/2013 which is a few grand (3...

Re: The (accidental?) Imposition of Forced Inheritance.

"Under the new rules, the courts of the EU country where the person usually lived at the time of their death will deal with the inheritance and will apply the law of that EU country. However, citizens can choose the law of their country of nationality to apply to their estate, whether it is an EU o...

The (accidental?) Imposition of Forced Inheritance.

In the event of the UK leaving the EU without a Withdrawal Agreement in place it seems to me that UK nationals cease to be EU citizens with immediate effect. This would surely take them outside the scope of EU Regulation 650/2012 which allows for EU citizens to specify in their Will that the law of ...

Re: Cyprus estate

Since then a year ago my Mother died, she had a UK will, which did not mention the land and bank account in Cyprus but no will in Cyprus. The UK will has been sorted as far as UK issues are concerned I am a layman in all these matters but my understanding is that the UK imposes inheritance tax (IHT...

Re: Applying for 'Final Completion Certificate'

The process is described on pages 12 & 13 of the Department of Lands & Surveys Citizens' Charter . Many thanks. That also looks to be a very useful document for general reference - although the title might be thought a tad misleading by some. I'll take the documents I have down to the Limassol offi...

Applying for 'Final Completion Certificate'

When buying my home it was discovered that the "deeds" stated that it was a plot of land and recorded no buildings on it. Land Registry have the building in their books of plans and took it into account when making their initial proposal for the basis of calculation of the transfer fee payable. My l...
