Responsibility for building structure

Hi Nigel
We are about to take over the running of the communal areas of our complex. Can you advise if the developer remains legally responsible for the upkeep of the structure of the building? Ie if there were structural issues would they be responsible for repairing them or would that fall to the management committee to resolve.

Hi Bart,
The Management Committee is responsible for the insurance, maintenance and repair of the common facilities, etc. You can read more about this in an article written by Louise Zambartas at

In the event of a structural failure, the Committee would need to get an independent assessment of the problem from an ETEK registered engineer and a written report. If the report concluded that the structural failure was due to poor workmanship, poor quality materials, design defects, etc. - the Committee could take action in the court for the developer to repair the problem. If the structural fault resulted from inadequate maintenance/repair of the common facilities, the Committee (I believe) would have a hard job winning the case.
