Complex insurance

Hi Louise
We are 14 owners of a new complex of 108 apartments. We have tried to set up a legal committee but there are currently too few of us as we believe the developer still owns more than 50% of the apartments (many are empty). We are paying him maintenance for the site even though we never signed a contract for this. He is refusing to arrange insurance for the communal areas and we are very concerned that we could all be jointly liable if anyone, including trespassers, have an accident on site. What is our legal position as we don't yet have our title deeds? Also there are no signs up at the entrances to the site to tell people they are entering private property, nor are there any signs etc near the pools. What are the rules regarding pools as we understand complex pools are still classed as 'public pools' and should therefore have lifeguards on duty?
We would be very grateful if you could give us some advice on what to do. Nigel Howarth and Andrew Stott recommended you to us and Andrew would appreciate it if you could copy him in to your reply.
