Fencing round roof tanks and solar panels

Hi Nigel,
We are part of a small complex (14 houses) surrounding a communal pool. The developer sent us the following message in December 09: " According to the new law that the Housing Department has introduced, the solar panels/boilers/water tanks have to be hidden with wooden trellis. Also, the Municipality is requesting the installation of four garbage tanks which will have to be facing the public road for easy access".
From our research we believe this work is the developers responsibility as the law was enacted in 1990, not just recently. Can you provide any background.

Hi Ian,

I cannot give you a categorical answer on this, but it is my understanding that the regulations concerning the visibility of solar panels, water tanks etc from street level have been in force for quite some time. (I remember the subject coming up with our architect back in 2002 when I asked him about the rather odd half-roofs you see on many buildings.)

Also, as building regulations are not retrospective they will not affect properties that were built before they were introduced.

If your developer has the required planning and building permits for the complex as it has been built, you shouldn't have anything to worry about.
