Boundaries Who is responsible ?

The land registry have informed our developer, and us, that we own a large part of the adjoining land.

The developer seems to think that we must claim the land through the Muchtar, but as we don't yet have the title deeds from them, surely it is their responsibilty, to establish the boundary of the land THEY still own.

If the land is still registered in the name of the property developer he should arrange for it to be surveyed and its boundaries to be plotted accurately and entered on the cadastral plan. (He may have already done this as part of the development).

Although he could get the Land Registry to do this, it will be much quicker if he uses one of their licensed private surveyors. You'll find the list at http://www.moi.gov.cy/moi/DLS/dls.nsf/A ... _10_09.pdf

There's absolutely no reason to claim the land from the Muchtar - if the Land Registry says it's yours, it's yours!

I suspect the developer may be reluctant to raise the subject with the Muchtar because of friends, family ties, or whatever.

Excuse me for sound a bit dim, but just how does the land registry inform you that the land is yours if you have NO title deeds??

Perhaps if you explained a little more, we could give a more fuller answer.

The land would belong to whoever is on the title (ie the developer) and I don't see him giving it up that easy.

Unless you have a contract that specifically states that many metres, but I don't see the Land registry getting involved on individual levels unless someone has complained or asked.

The Muktar has no bearing on this, so no need to involve him.
