Bad Debtors Rights

Hi
can bad debtors still make use of communal areas / property (Pool ect)

Do you mean people that haven't / don't pay communal fees?
If they don't pay they cannot use the facilities. Of course you cannot block access to their property.

Hi
thes havent paid for 3 years but allow day guests/ friends etc to use the pool.They are not in residence themselves

They have no right to use the pool and neither do his guests/friends. Tell them to leave or you'll call the police. What does the Management committee have to say about this??

I wish, legally they own a piece of the pool so it’s difficult at the moment, there are changes in the pipeline to give committees more powers to get bills paid, I believe restricted access maybe one of these new powers.

You cannot prevent him from going to his apt, but he can't have it both ways, to own a share of the jointly owned building and at the same time not pay for its upkeep. Every one is obliged by law to pay communal fees and the MC should be taking him to court to recoup this money.
My wife is a property services manager on a large complex, it is a gated access and the pools are card entry. When they owners don't pay, they don't upgrade the card so the get no access.
I think your chair should be talking to a lawyer, you may find if he got a letter from a lawyer, he might just pay up.

I attended a seminar a few years ago on managing complexes.
The lawyer running the seminar confirmed that people who don't pay their communal fees can be banned from using communal facilities (including a swimming pool.
