Hi Nigel,

The Final Clearance Certificate for my house was issued 30 years ago. Since then the pavement at the front of the house has deteriorated.
The surrounding area is now being developed and I would like to get it sorted.
Am I right in thinking that once the Certificate was issued, it became the responsibility of the Local Council?

Hi Finikaria Freedom and welcome to the forum.

You'll need to check your Title Deed, but I suspect (like me) you own the pavement & therefore responsible for its repair and maintenance.

When you build a house you allocate land for the pavement for which you are made to put in place. As part of the process you have to surrender that pavement land to the state and once this is done the sate are responsible for it.

Getting the FC would suggest that this action has taken place meaning that the state (read local authority) are responsible for it.

Of course if it is all busted up and you are expecting them to come and fix it up, then err! You might have a long wait. if you want it nice and new and clean then you may do it yourself, but to answer your question, the local authority are responsible.

I will probably get the work done myself, my fear is if it is not done to their satisfaction, they will ask for it to be torn up and done again.
In view of that I will talk to the Muchter and get his approval.
Following on from that I intend to construct a retaining wall at the front of the plot and along the boundary line between the adjoining plot.
Are there any height restrictions for retaining walls and would I need planning permission ?

Your original planning permission should have allowed for a boundary wall, you should read the conditions. Your architect should be advising you on this, since the planning department may have set a particular height.
