Hi Nigel,

We have a dispute with our village Muktar regarding (Rymatomia), we would like to install pavements so we can get our title deeds, the problem is we have no building license we have been told we could maybe get a copy from poleodomia? in limassol but we don't know who originally applied for the license! Would it be down to plot number or an individual person? We need to know if a certain amount off land was signed over for public use. Hope you can help us with this and maybe supply an address or e-mail as we are in the U.K.

Hi Allison

It's extremely unlikely that you will be able to resolve this via email - you really need to be here to do some digging. The planning authorities file details of planning applications according to their reference number - this may be recorded in your contract of sale.

If the property is in the Limassol District, the planning offices are located behind the District Office in Anexartisias. Each of the small offices deals with one or two of the villages.

Someone will (should) have applied for a licence. If they didn't I'm surprised that your lawyer didn't uncover the fact when you purchased the property.

Dear Allison,

when you say we have no building licence, do you mean you don't have a copy of it or do you know one was never issued??

Without the building licence it is unlikely that you would have had electric and water connected (although there are cases where they have been). The Poleodomia does not give building licences (they issue planning licences). First, thake your contract and passport/ID and go to the Limassol district authority offices and speak to someone there. Ask them for a copy of it. You will really only need the front sheet as the actual licence is a file possible a few inches thick. You know the developer so they should be able to find it.

If they tell you there is not one, they you should demand to know why the developer was allowed to build the properties without it and that they have the responsibility and that you will be seeking legal action (try scaring them a bit).

In fact, it should have been the muktars office that issued the bl**dy licence anyway.

Installing pavements does not automatically get you your title deeds as there may be other factors also affecting the issuing of the final certificate, without know much else about your property I cannot comment further, sorry.

I would also check the content of the sale contract, does it mention building licence, does it say ' .... pending the issuing of the building licence ....' in any case you would have a case against the developer at that unless you bought a resale!!!
