Complaints toThe Disciplinary Board of Advocates
Re: Complaints toThe Disciplinary Board of Advocates
Nigel,
How long did the complainers wait for the Board ?
AndyP is on holiday just now but both off us and our UK Lawyers etc wonder as both our cases is straightforward criminality that a Disciplinary Board instead of a court is dealing with these cases ?

Re: Complaints toThe Disciplinary Board of Advocates
Hi Scots Lad
I don't know how long the complainant had to wait.
A complaint to the Cyprus Bar Association is a complaint about the conduct of a lawyer. If your lawyer considers that a criminal act has taken place you may have to take action against the lawyer through the court.
Regards,

Re: Complaints toThe Disciplinary Board of Advocates
Nigel,
As ever thank you for the Information, With Andys case he been waiting about three years we thought it might have been faster after she got a presidential pardon for other offenses, but she then got pregnant and adjournements became the SOPs .
My case is four years, Even with the BHC /MEPs UK Police putting pressure on it seems the silence from the Island is deafening.
Nigel with regards to appointing another lawyer to take the Rogue on, this many people will find difficult to find such a lawyer. The VP of the Paphos lawyers has even gone public stating he would never call a fellow lawyer a liar.
This is a problem Cyprus needs to address in the future that lawyers who have committed criminal acts against clients should face a criminal court not a disciplinary board and be judged on this.
Hopefully this will happen, The President of the CBA term is almost up and maybe his replacement may judge his position as a person to fight for clients not members, I think for all concerned State, clients, lawyers, Fresh Blood is needed to repair the image and reputation of the CBA

Take a look at http://www.news.cyprus-property-buyers. ... /id=004686 - the name of the law firm that brought a successful action against a Paphos-based lawyer is named.Scots Lad wrote:Nigel with regards to appointing another lawyer to take the Rogue on, this many people will find difficult to find such a lawyer. Re: Complaints toThe Disciplinary Board of Advocates
Nigel,
Thank you I remember now the case the couple fought for 10 years plus, with the Ussual Paphos court decisions thrown in as well . I just wonder if the guilty lawyer is still practising ?
Did the disciplinary board do nothing ?
Well done the two lawyers who fought for the couple and won. Shame not more off the 1900 plus lawyers in the CBA do not follow the example set by these lawyers maybe they prefer to remain silent and members of the Club.
I think this just proves that Cyprus needs the CBA / AG office radically changed with a clear out at the top. But will this happen ?

Re: Complaints toThe Disciplinary Board of Advocates
Nigel,
Mine has over 40 complaints against him my case also drags in three other law firms who have all broken the CBA Code of Conduct !
Andy P The famous Stiquette has 25 plus victims !
It appears that if they find one guilty they are scared it would bring down so many others so we have the code of Omerta from members off the CBA from the Top down a very sad state off affairs for the Republic and its citizens.

Nigel,
Regarding the couple who won there case. It was not won in the Disciplinary Board but in the Supreme Court.
So we really are back to the Question.
Has the Disciplinary Board off the CBA chaired by the AG ever found in favor off a Complainer and why should they judge cases that are off a criminal nature should that not be the role off the prosecution service which reports to the AG ?

Re: Complaints toThe Disciplinary Board of Advocates
Hi Scots Lad
I didn't explain my self very well:
I know of one case where the CBA Disciplinary Board found in favour of the complainant.
I know of one case where a law firm brought a successful action against a lawyer in the Supreme Court.
In both of the cases above, the lawyers are still in business - and both are based in Paphos.

Re: Complaints toThe Disciplinary Board of Advocates
@ Nigel,
I have been reading the active thread on developer mortgages and Rodger Snellings experinces does it not just expose the plight off Home owners/purchasers when they enter the Cypriot property market.
That rogue lawyers are not just a few rotten apples in the barrell but would appear to be a sizable number that the CBA/AG are doing nothing about.
The Courts seem to have more adjournements then actual court days hoping to wear down the victim.

Re: Complaints toThe Disciplinary Board of Advocates
Hi Nigel.
I have just received a letter from The Attorney General regarding my complaint advising that " The Disciplinary Board granted leave for the commencement of disciplinary proceedings, under section 17(2) of the Advocates Law" A charge sheet, in Greek is also attached which I will need to get translated.
I have also been asked to appear at The AG's office on 12 October "to present the case"
It seems odd that 2 years ago I had to put my case in writing and paid my fee. They then agreed to investigate and found grounds in my favour. A hearing was called for the Stigette to attend which I understand took place last week. And now this. Why another hearing if they seemingly keep finding in my favour?
I was wondering if you or anyone else new if this was normal procedure or whether it was just more of an ongoing farce?
Thanks

Re: Complaints toThe Disciplinary Board of Advocates
AndyP ref your last post With my case they had no charge sheet same with other people I know who had valid complaints. Also in my case i must have sent the evidence at least 3 times each time the Board would not respond childish of them.
Looks like they are changing the rules as they go along in the hope you give up and go away ?

Re: Complaints toThe Disciplinary Board of Advocates
Not prepared to go away Scots lad.
I am hoping for a break in the norm but obviously only you have been this far as no other replies.
I have sent my charge sheet away for translation and assuming I get Nigel's permission I will publish it here.

Yes I hope Nigel prints it as it appears to be the latest gimmick the Board is coming up with in its protection off Rogue lawyers.
You may have seen the latest letter from the President off the Cyprus Bar Association saying he is not to be bothered over complaints about his members ?
The Buck stops here does not apply to this President
