Public Liability

Hi there,

I am an owner on a complex and we are pretty sure the developer or managing agents have not taken out any public liability insurance.

Our sale contract states that we as purchasers have acquired the right of common ownership of areas such as the hallways and stairs.

There are two issues with the development:- 1. the lack of electricity to the common areas (due to the electricity board cutting it off due to non payment by the management company - who in turn say they weren't paid the mgt. charges by the owners) and 2. a pile of rubbish, excrement etc in the basement caused by beggars gaining access and living there.

If there was an accident caused by the lack of light due to no electricity, or a health problem caused by the waste in the basement, who would ultimately be held accountable legally? the developer, the managing agent, or the owners jointly?
