Will for Land

#1 Post by irinix » 07 May 2012 07:36

Hi Louise, if land has been registered jointly on a widowed parent and childrens' names, what happens to the parent's portion of the land should they pass away? Parent does not have a Will in Cyprus however the family are Cypriot citizens living outside of Cyprus.
Does the land get split evenly between the children? Or does the parent still need to draw up a Will for his share to be passed on to his children?
If no Will is in place, can other Cypriot family members like aunts, uncles, cousins etc make a claim on the parent's share of the land?

Thanks for your advice.

Hello irinix and welcome to the forum,

Unfortunately, Louise rarely has the time to visit these days. If you want to contact her directly, you can do so at the LG Zambartas LLC Law Office at http://www.zambartaslawoffices.com/

The rules of inheritance for Cypriot citizens are quite complex and it could be that if the parent passes away intestate (without making a Will) their children and other family members - including the parent's brothers, sisters, half-brothers and half-sisters - and their descendants, etc. will inherit part of their estate.

There s an article written by the law firm of Andreas Neocleous & Co LLC that explains the situation in a bit more detail at http://www.mondaq.com/article.asp?articleid=53544

In simple terms, the parent's portion gets divided between the children when they finally pass. If there were no children then the next in line would be their parents, brothers, sisters, cousins.

If you have land jointly with one of your parents, will or no will, it will come down you you and your siblings.

If it is possible (and all family relationships are not harmonious I understand), perhaps your surviving parent would transfer to you his/her share before that time comes??

Just a thought.
