Title deeds imminent and alterations

Hi there
We are interested in a property but are told title deeds are imminent. An AX number has been given. We have instructed a lawyer from the list by the British High Commission to look into the timescale of the title deeds being issued as this is a resale property on a development where we believe that everyone is still waiting for their title deeds. I assume that these will be issued all at the same time. Our lawyer is doing a thorough search to make sure that all procedures have been followed in applying for the AX number, no mortgages etc and to find out when title deeds will be issued. I hope we are doing the best to try and protect ourselves if we go ahead with the purchase.

Also as a matter of interest, the house has a garage space but no door. Would we be allowed to add a door before title deeds are issued or would we have to wait until house is in our name? Also changing a window into sliding patio doors?

Hi,

Don't do anything until you actually have the titles in your names. By adding a door to the garage makes it covered habitable area and this is a violation. Also to change the external aesthetics, ie windows into patio doors is a no no right now.

Just wait until you have the title deeds then do what you want (subject to planning of course).

Hi just meant to ask how long planning permission takes to be granted in Cyprus?

Hi Gemmitch

You're looking in the region of 3 months to get planning permission - but it could be longer if there are problems.

If your car port is attached to the main property, the planning authority will most likely consider it a habitable area:

1. This could take the area of the habitable area over the planning density limit for your (planning consent would be refused).

2. If the car port goes up to your boundary wall planning consent would also be refused as you generally need to leave 3 metres between the habitable area of the property and its boundary wall.

Although what Nigel says is correct, I have yet to see or hear any planning issue with say a garage roller door.

If you want to do things legally and properly then the planning route is a must, otherwise ;-) I wouldn't worry too much about it.
