No Title deeds
Hypothetically, if the property, paid for in full to the developer, which has not yet been issued with title deeds still belong to the developer?

Yes - until the Title Deed to the property has been registered in the name of the purchaser, the vendor remains the property's legal owner. (You can delete hypothetically)
If you do not have the deeds, I suggest you apply for them as described in my article Applying for Title Deeds.

Applied for title deeds a few years ago, have chased and chased but no progress so far.

As we have no title deeds and the property therefore still belongs to the developer, why is it included in an estate for probate?
