management committee

We are a complex of 5 houses do we require a management committee by law if yes what is the minimum number required.

Hi Robert

As your complex has five units you are required to have a management committee by law.

Premises consisting of two to four units may constitute a building under joint ownership and be registered as such, if the owners of at least fifty per cent (50%) of the joint ownership or any two owners of units submit an application to that effect to the Director requesting that these premises constitute a building under joint ownership and be registered as such.

Nigel, these are 5 houses there is nothing jointly owned as such. How does the law still apply here??? Unless of course there is a communal pool, private road and gardens!!!

Ware a block of 5 townhouses the communal pool is at the side of the last house.Access to the pool is either from the rear of each house onto a private footpath leading down to the pool or from the from the front of each house onto the public footpath then turning off the public footpath into our pool area.we have no gardens or private road.

Hi Bob - yes you do need a Management Committee.

(Incidentally the minimum number of persons on a Management Committee is one).
