Before you obtain your title deeds your builder/developer pays various taxes and costs on your behalf. They then claim the monies back from you on a "Statement for Title Deeds" that you have to pay to start the title deeds process. This includes Council Tax up to when you get your deeds and IPT up until 2012. In the case of Paphos area properties they will also have paid Paphos Sewerage Board Fees which have now been repaid to them. Your builder/developer may well not volunteer a refund so check your "Statement for Title Deeds" and chase them for the cash.

If you apply for Title Deeds as described at http://www.news.cyprus-property-buyers. ... d=00126681 you will avoid this issue. The Land Registry will check whether you have fulfilled your contractual obligation towards the developer, including the payment of any IPT, Council Tax and Sewerage Board charges.

If you have not fulfilled your contractual obligations, the Land Registry will send you a notice asking you to pay these taxes to the relevant authority. And if you pay IPT you will pay it at a much lower rate than the developer - hence there will be nothing to reclaim.

You need to check your contract of sale. Virtually all the ones I've seen over the years oblige the purchaser to pay IPT and other property-related taxes from when the property was delivered to them. In this case you should pay the developer. BUT you can reclaim any legitimate overpayments of IPT from the Tax Department once you have the Title to the property.

Builders/developers will not refund you. You have to apply to the Tax Department for a refund - your developer will probably have to assist with your application.
