Non Payment of Communal Fees

Hi all,

I am not sure how true this is but I have been told by our complex management company that it is now legal for the management company/developer in conjunction with the electricity board to be able to cut off electricity supply to non payers of communal fees.

I would like this to be true but before e-mails/letters are sent to non-payers can anyone advise if this is really the law?

Sounds like a good idea, but I would be very surprised if it were true.

The only people legally able to cut anyone off is the electricity board. Why they would get involved in other people's squabbles is anyone's guess, unless the non communal payer didn't pay his electric.

This is only my logical opinion, as it is the first I have heard of this.

This is a new one on me - and I too would be very surprised if it were true.

How could the EAC cut of your private electricity supply if you paid your private bills?

We are about to take over the running of the communal areas of our complex. Can you advise if the developer remains legally responsible for the upkeep of the structure of the building? Ie if there were structural issues would they be responsible for repairing them or would that fall to the management committee to resolve.

Hello sara and welcome to the forum

The Management Committee needs to build up a sinking fund to pay for repairs to the building.

The EAC can and does cut off the electricity supply to non-payers.

I've been there several times to have friends and neighbours supply re-connected after they let their accounts slip into arrears. Whilst on the Management Committee, we always ensured that the accounts of the public areas were paid so had no problems there.

I think the question concerns the disconnection of private residences if their owners have not paid their management fees.

But I may be wrong.
