Hi Nigel,
Yes the agreement is as you state. The problem with what seems to be the only legal course of action is that it costs money that we haven't got to go to lawyers and even when you get a judgement it could be years before it made a scrap of difference to the offending owner and maybe never ...

Non Fee payers - the continuing battle
Our General Agreement states that non fee payers may not bring vehicles on to the complex or use any of the facilities. Obviously this is ignored. We threaten to clamp any vehicles bought on to the site by the non payers. If we actually did that do you think that the police would then side with the ...

Re: Bank account to run a complex
Hi Nigel,
Yes I did read that thank you but again we would be stumped. You are supposed to have the next meeting the following week but no one is ever on site for more than a week so it wouldn't be possible in strictly legal terms. Many thanks again for your input. No doubt we will find a work ...

Re: Bank account to run a complex
Hi Nigel,
Thank you for your response. I assume that the item 38V of the law would enable a committee to be set up but wouldn't its hands then be tied by the rest of the law asking for 75% agreement on many things plus the impossiblity of holding legal meetings. Most owners are based abroad and may ...

Bank account to run a complex
I wonder if you have a suggestion for the following problem. We are an unofficial management committee and with over 50% of owners missing and uncontactable it would appear to be difficult to form a registered committee. Up until now we have used a bank account with a couple of names on it to run ...

Complex Insurance
Hello Nigel,
We take out insurance via our developers to cover our complex. Last year we got a better quote from a UK company but we were told that we could not use them as the insurance had to be from a company under Cyprus jurisdiction. We duly paid the premium to the developers but can not get ...

Usual unpaid fee problem
We are a complex where we have a few owners who come and use their properties for about one continuous month each year but will not pay any management fees. The usual legal procedure would be a waste of time as they come from a non English speaking country in which any such action would be totally ...
