Hi Nigel,
On the subject of forming a Management Committee (bagsound 24th May 2019) is there not a requirement in the Law that says some of the MC members must be owners who reside permanently on site?
Kind regards,
Barry.

Re: Green Area
Hi Nigel, Are you sure that what is designated as a "Green Area", adjacent to a communally owned development, is actually owned by the owners of that development?. My understanding is that these "Green Areas" which are provided as a condition to building approval by the developer, are actually owned...

Re: this swimming pool malarky
Hi Nigel, In your article on 27th August 2018, regarding your meeting with the Executive Engineer of Peyia Municipality on that same day, You list 8 points that she advised were needed to be compliant in order to gain a pool licence. Can you please advise further on point 4, "The completion of forms...

Re: this swimming pool malarky
Hi Happy Camper, First of all I assume Blue Orange are the Management Services Company that are responsible for all the services on the complex and not just the swimming pool. Further, do I presume Peyia Chorio 2 was built by Pafilia. If that is the case, Blue Orange, the re-branded name of Pafilia ...

Registration of Regulations
Dear Nigel, I thought you and Members of the Forum would be interested to learn of a success story at last. We have just recently successfully registered our "Management Committee Regulations" with the Paphos Land Registry. All the necessary documents including a set of Regulations were lodged with ...

Re: Changing communal property management company
Hello Emgee, I am referring to "Self Management", not "Self Help", two entirely different things. We, the Management Committee invite quotations for the various services needed to maintain our complex, pool maintenance, garden maintenance, cleaning services, pest control etc and eventually choose wh...

Re: Changing communal property management company
Hello again MattiGeorge, Your Developer cannot, under any circumstances, disagree with a decision taken by a majority of owners provided it is a decision brought about by due legal process ie, a postal vote. You do not need an approved new voting form from your Developer when you can easily produce ...

Re: Changing communal property management company
Hello MattiGeorge, Check the wording in your Management Agreement that all owners would have signed when you first bought properties on your development. It should say that the Management Services Company can be replaced if a majority of owners so wish and by giving the required notice period in wri...

Re: registration of chairman and committee
There is no provision as yet at the Paphos Land Registry for the Registration of a Committee let alone a Chairman. The only thing you can register is your Regulations which incur a fee of €60.

Return of Deposits
Dear Nigel, We have just terminated our management agreement with our developer who has administered the site since they built it. Upon the purchase of units on the site, each owner had to pay an interest bearing refundable deposit which was to be held in a common fund and returned in the event of s...

Re: Regulations
Hi Nigel / Bart, just a thought if you have not by now produced your Regulations. Ours cost us over 1000 euro's by the time our Lawyer endorsed them as compliant with current legislation. I met a couple the other day who told me they had updated and completely re-wrote the example "Troodos Hills Man...

Re: Management Committee
Hi Nigel,
I went down to the Paphos Land Registry the other day and spoke to the supervisor at the Department of Lands & Surveys. She informed me that they no longer Register Committee's or their Regulations. So much for the 2011 Citizens Charter. Were you aware of this ?
Best Regards, Barry.

Re: Management Committee
Hello Nigel, Thanks for that. We have used the sample Regulations as a template for our own, with a few additions and amendments to suit our own complex. Do you recommend we have our document checked by a Lawyer before we issue to all Owners.
Best regards, Barry.

Re: Management Committee
Hello Nigel, Just to be clear,we have not got that far yet. We are using a Lawyer to prepare and authorise our Regulations, as you have recommended on many occasions in the past. Once prepared, do I understand we do not need the Lawyer to Register these Regulations or the Committee and we do that bi...
